Booking Terms & Conditions

Whale Sighting Guarantee*

We are passionate about helping guests experience Sydney’s annual whale migration. While whale sightings are extremely common during the season, whales are wild animals and sightings cannot be guaranteed.

In the unlikely event that no whales are sighted during your cruise, A Boat Agency will provide a complimentary return whale watching cruise.

The complimentary return cruise:

  • Is valid for up to three (3) years from the original cruise date.
  • Is available only to the original guest named on the booking.
  • Is non-transferable and cannot be exchanged for cash.
  • Is not refundable.
  • Is subject to availability and advance booking.

No refund applies if whales are not sighted during your cruise.

Booking Amendments

Guests may request changes to their booking up to 24 hours before the scheduled departure time.
Requests received within 24 hours of departure may not be accommodated and may result in forfeiture of the booking.
All booking changes are subject to availability.

Cancellations by Guests

Cancellations made more than 24 hours prior to departure are eligible for a full refund.
Cancellations made within 24 hours of departure are non-refundable.
Failure to arrive for a booked cruise is considered a no-show and is non-refundable.

Cancellations Due to Weather or Operational Reasons

Cruises may be cancelled due to weather conditions, ocean conditions, safety concerns, vessel maintenance, operational requirements, or circumstances beyond reasonable control.
If a cruise is cancelled by the operator, guests will be offered either:
A transfer to an alternative departure date, subject to availability; or
A full refund of the amount paid.

Departure & Check-In

Guests should arrive at least 20โ€“30 minutes before departure.
The vessel departs on schedule and cannot be delayed for late arrivals. Guests arriving after departure may forfeit their booking and are not entitled to a refund.

Health & Safety

Whale watching takes place on open ocean waters where conditions may vary.
Guests who are pregnant, have mobility concerns, medical conditions, or are prone to motion sickness should consider their suitability for the experience prior to booking.
All guests must follow crew instructions at all times. The operator reserves the right to refuse boarding or remove any passenger whose behaviour may affect the safety or enjoyment of others.

Gift Vouchers

Gift vouchers are non-refundable and are valid for the period stated at the time of purchase unless otherwise required under Australian Consumer Law.

Limitation of Liability

A Boat Agency acts as a booking agent for whale watching experiences operated by third-party providers. While every effort is made to ensure a safe and enjoyable experience, A Boat Agency is not responsible for weather conditions, wildlife sightings, vessel substitutions, delays, cancellations, or operational decisions made by the tour operator.

Nothing in these Terms & Conditions excludes any rights available under Australian Consumer Law.


* The Whale Sighting Guarantee applies only where no whales are sighted during the scheduled cruise and is subject to these Terms & Conditions.
